Fatal Crashes in Texas

Nearly 375 people die as a result of crashes in Texas every month. These incidents are often preventable. However, we continue to see innocent people forced to deal with the overwhelming consequences of negligent and careless drivers. Fatal car crashes are often caused by speeding motorists, drivers who are distracted, and even aggressive driving behaviors.

After experiencing the loss of a loved one, it is critical that families take legal action immediately. Families often have the ability to file wrongful death claims against those responsible for the sudden and unexpected loss of their loved ones. A wrongful death action can provide financial relief for some of the damages that families face.

What Damages Can Families Pursue?

After a loved one loses their life in a fatal car crash, families can file wrongful death claims against those who are responsible. In Texas, families have a period of up to two years from the date of the fatal collision or the passing of their loved one to seek compensation for the losses and damages they face.

In general, families are able to seek compensation for the economic and non-economic damages that they face moving forward. Economic damages include:

  • Medical expenses
  • Funeral and burial expenses
  • Loss of financial support
  • Loss of future earnings

Non-economic damages that are pursuable in a wrongful death claim include:

  • Emotional distress
  • Loss of guidance and support
  • Pain and suffering
  • Loss of companionship
  • Loss of consortium

It is in your best interest to seek legal representation early on to ensure you have the best chance of getting justice.
