Car Accidents in Texas

Car crashes are one of the most common causes of injuries and death in Texas. These preventable accidents continue to have a debilitating impact on the lives of those involved. It is common for those involved to be left with spinal cord injuries, broken bones, and severe trauma to the head that requires extensive medical care and interrupts their lives forever.

After being hurt in a car crash, you have the ability to file a personal injury claim against the responsible party. In order to do so successfully, you must be able to demonstrate that negligence existed at the time of the crash.

What is Negligence in a Personal Injury Claim?

To file a claim successfully, you must be able to demonstrate the elements of negligence existed. In Texas, claimants need to establish that the defendant did not exercise reasonable care, leading to a breach of their duty toward the claimant. Next, the claimant must prove that the defendant’s failure to act reasonably directly caused the accident. Finally, the claimant must demonstrate to the court that the accident, resulting from the defendant’s breach of their duty of care, led to their injuries and damages. Victims who cannot establish the presence of all four elements of negligence at the time of their accident may encounter challenges in their recovery. This makes it vital for you to seek legal representation as soon as possible to ensure you have the best chance of proving your case.
