In Texas, you have the right to file a claim for personal injury even if you share some fault for the accident. Texas follows proportionate responsibility laws when it comes to personal injury cases. These laws allow victims to seek compensation for their accidents, even if they bear partial responsibility.

To recover compensation for losses and damages, a claimant must demonstrate that they shared less than 50% responsibility for their accident. Each defendant in a claim can forced to pay compensation for any resulting damages based on their degree of responsibility for the accident.
