After experiencing the loss of a loved one, families should seek legal guidance and consider filing a wrongful death lawsuit.

Proving Your Wrongful Death Claim

Wrongful death laws in Texas enable various parties to pursue a claim against the person responsible for the death of a loved one. Establishing negligence serves as a vital component in the majority of wrongful death claims. You must be able to demonstrate that the negligent actions of another driver caused the death of your loved one.

Four key elements will typically need to be demonstrated to establish negligence. This includes showing the following:

  • The existence of a duty of care owed by the defendant to your loved one.
  • A violation of that duty on behalf of the defendant.
  • Actual harm or damage.
  • A clear cause-and-effect connection linking the damage to the breach of the duty of care.

To provide yourself with the best chance of proving your case, it is recommended that you seek help from a dedicated San Antonio wrongful death lawyer.
