Fatal Pedestrian Accidents in Texas

Fatal pedestrian accidents take the lives of hundreds of people across Texas every year. There are countless instances where these accidents are entirely preventable. Unfortunately, innocent people often have to pay the price of drivers who are reckless and negligent. Leading factors in many of the fatal collisions reported across our state include:

  • Speeding
  • Distracted driving
  • Reckless driving

  • Running red lights

After losing a loved one in a fatal collision, your family has the ability to file a wrongful death claim against the responsible party. This can help your family get compensation for some of the damages you face. Including:

  • Pain and suffering
  • Loss of consortium
  • Funeral and burial costs
  • Lost earnings

It is crucial to take legal action right away to ensure your family has the best chance of getting justice.

What is the Statute of Limitations?

In Texas, you have the ability to file legal action following an accident. However, it is important that you file the claim within the appropriate amount of time. The amount of time that you have to file a personal injury or a wrongful death claim is referred to as the statute of limitations.

In Texas, the statute of limitations is two years from the date of the accident. There are some exceptions to this rule. However, it is important that you seek legal representation right away to ensure that your claim is filed in the appropriate amount of time. If you fail to file your lawsuit within the applicable statute of limitations, you are barred from recovering any compensation for the losses and damages you face. It is imperative to seek legal representation from a dedicated wrongful death lawyer immediately to ensure you have the best chance of getting justice.
