Car Accidents in Texas
Tens of thousands of automobile accidents take place every month in Texas. These accidents add up to hundreds of thousands of people being left with injuries every year. Far too often, car crash victims are forced to go through extensive medical treatment and spend significant time off work to recover from painful physical and emotional injuries.
After being harmed in an accident, it is crucial that victims are aware of their legal options. In Texas, car crash victims have the ability to file personal injury claims. This type of legal action is filed in civil court and aims to hold the negligent driver accountable for their actions. A personal injury claim can help you recover compensation for your medical costs, lost wages, and more.
Can I File a Claim if I am Partially At Fault?
In Texas, personal injury cases are governed by comparative negligence laws. These laws provide crash victims with the ability to pursue compensation even if they carry some degree of fault for the collision taking place.
To qualify for recovery, a victim must establish that their fault is less than 50% in the collision. In a personal injury claim, each defendant’s liability for damages is determined by their share of responsibility for the crash taking place. If you share any fault, your total compensation for damages will be reduced in proportion to your level of responsibility. It is advisable to work with an experienced personal injury attorney in Texas to demonstrate that the other party bears the majority of the fault in your accident to ensure you are able to get a fair share of compensation for your damages.
