Auto Accidents in Texas

Crashes occur daily in Texas and have a significant impact on the lives of those involved. It is common for victims involved in motor vehicle crashes to suffer serious injuries that affect their lives indefinitely. Common injuries reported in vehicle collisions include:

  • Internal organ injuries
  • Burns
  • Traumatic brain injuries (TBI)
  • Spinal cord injuries
  • Herniated discs
  • Broken bones
  • Seatbelt injuries

After being harmed in an accident, you have the ability to take legal action against the responsible party. In order to prevail, you must be able to prove that negligence existed at the time of the accident.

What is Negligence?

Negligence in the context of a car crash refers to the failure of a driver to exercise reasonable care while operating a vehicle, resulting in harm or damage to others. It involves a breach of the duty of care that all drivers owe to fellow drivers sharing the road. To establish negligence in a car accident, the following elements are typically considered:

  • Duty of Care: As part of the driver’s duty of care towards other drivers on the road, they must operate their vehicle responsibly and safely.
  • Breach of Duty: The driver’s duty must be breached when the driver fails to meet expectations of care in a particular situation. Examples include speeding, distracted driving, and disobeying traffic laws.
  • Causation: The breach of duty must directly cause the accident. In legal terms, it must be established that the accident would not have occurred “but for” the driver’s negligent actions.
  • Damages: The accident must have caused actual harm or damages, such as injuries, property damage, or other losses.

If these elements are proven, the driver may be deemed negligent, and they could be held legally responsible for the damages caused. It is in your best interest to seek representation from a Texas car accident lawyer right away.
