Texas Fatal Car Accidents
A fatal car accident can have a significant impact on your family. Unfortunately, these accidents take the lives of thousands of people every year in Texas. The sudden and unexpected loss of a loved one can be extremely emotional, leaving your family to grieve indefinitely.
Unfortunately, fatal accidents bring with them a lot of financial uncertainty. We see countless families forced to pay funeral costs, burial expenses, and more. To help alleviate some of the damages your family faces, it is important to file a wrongful death claim.
What is a Wrongful Death Claim?
A claim for wrongful death is filed in the aftermath of a fatal accident. These claims are designed to hold reckless parties accountable. To file a claim successfully, you must be able to demonstrate that negligence was a factor in the accident that claimed the life of your loved one. This includes showing the following:
- Duty of Care: The defendant was legally obligated to act reasonably to avoid harming the deceased person.
- Breach of Duty: The defendant failed to meet this obligation by engaging in some reckless action. This could be speeding, driving impaired, or even using their phone while behind the wheel.
- Causation: The defendant’s breach of duty caused the deceased person’s injuries or death.
- Damages: Your family suffered financial losses or other losses, such as emotional distress, as a result of the death.
After demonstrating these elements, you have the ability to recover compensation to alleviate both the economic and non-economic damages that your family has been forced to endure.
To provide your family with the best chance of maximizing the compensation you recover in holding the negligent party accountable, it is in your best interest to seek guidance from a wrongful death lawyer early on. Your attorney will be able to start building your case and showing all of the elements of negligence existence so that you are able to get justice.
