Fatal Car Accidents in Texas

Over ten people lose their lives in automobile accidents daily in Texas. These incidents add up to thousands of lives lost each year on roadways across our state. Far too often, these accidents are a result of negligent drivers.

Far too often, innocent people lose their lives as a result of preventable accidents. When drivers do not operate their vehicles in a safe manner, it can have devastating consequences.

After the loss of a loved one, you have the ability to file a wrongful death against the responsible party. In order to recover compensation, you must be able to prove negligence.

What is Negligence in a Wrongful Death Claim?

In Texas, it’s essential for claimants to prove that the defendant’s lack of reasonable care amounted to a breach of their duty toward the claimant. Subsequently, claimants must establish that the defendant’s failure to act reasonably was the direct cause of the accident.

Finally, claimants need to convince the court that the accident, resulting from the defendant’s breach of their duty of care, led to the loss of their loved one and damages. Those who cannot demonstrate the existence of all four elements of negligence during their accident may face hurdles in seeking compensation. This makes it imperative for you to seek legal representation from an Austin wrongful death lawyer as soon as possible.
