Fatal Auto Accidents in Texas

Every day, more than ten individuals lose their lives in car accidents across Texas. These incidents contribute to thousands of fatalities annually on our state’s roads. Unfortunately, many of these accidents result from negligent driving behaviors.

All too frequently, innocent lives are lost due to preventable accidents. When drivers fail to operate their vehicles safely, the consequences can be devastating.

Following the loss of a loved one, surviving family members have the option to pursue a wrongful death claim against the accountable party. To obtain compensation, you must demonstrate negligence.

What Constitutes Negligence in a Wrongful Death Lawsuit?

All drivers are obligated to exercise a duty of care toward others. When pursuing a personal injury claim in Texas, plaintiffs must establish that the defendant’s failure to exercise reasonable care amounted to a breach of this duty. Consequently, plaintiffs must prove that the defendant’s negligent actions directly caused the accident.

Furthermore, plaintiffs must convince the court that the accident, resulting from the defendant’s breach of duty, led to the loss of their loved one and associated damages. Failing to demonstrate all four elements of negligence may present challenges in seeking compensation, underscoring the importance of securing legal representation from an Austin wrongful death attorney immediately.
