Car Accidents in Texas

Every year, car accidents leave hundreds of thousands of people in Texas injured. These accidents occur so frequently that approximately one person is injured every two minutes in our state. Unfortunately, many of these accidents occur due to negligent drivers.

When drivers fail to operate their vehicles safely around others on the road, the consequences can be severe, even deadly. Countless innocent individuals are left to cope with painful physical and emotional injuries as a result. After being harmed in an accident, victims have the option to file personal injury claims against those responsible. Proving negligence in an automobile collision is crucial, but understanding comparative negligence and its impact on your case is equally important.

What is Comparative Negligence and How is it Applied in a Car Crash in Texas?

In Texas, the allocation of liability in car accidents is determined by fault, as outlined in Tex. Civ. Prac. & Rem. Code Ann. § 33.001, known as the comparative negligence standard. In cases where multiple parties bear responsibility for the same crash, fault distribution determines their respective liabilities for resulting damages. For example, if you’re involved in a highway collision with two other drivers and the first driver is found to be 80% at fault, they would be accountable for 80% of the total damages. The remaining 20% of the blame, assigned to the other driver, would result in them being responsible for 20% of the damages. Seeking legal representation from a car accident lawyer in Texas is essential to ensure you have the best chance of maximizing your recovery.
