Car Accidents in Texas

Dealing with the overwhelming aftermath of an automobile accident can be quite challenging. This is particularly true if you have been injured. Unfortunately, tens of thousands of people in Texas sustain serious injuries that affect their ability to perform an array of tasks every single year. Regrettably, many of the accidents take place due to negligence. After being hurt in a car crash, you have the ability to take legal action against the responsible party. It is important that you understand the loss of comparative negligence when it comes to proving your case and maximizing your financial recovery.

The Impact of Comparative Negligence

In Texas, the concept of comparative negligence plays a significant role in personal injury claims arising from car accidents. Texas follows a modified comparative fault system, meaning that if you’re found partially at fault for the accident, it can impact your ability to recover damages. If you are deemed to be 51% or more responsible for the accident, you may be barred from seeking compensation. However, if your fault is assessed at 50% or less, your recoverable damages will be reduced in proportion to your degree of fault. Understanding and navigating the intricacies of comparative negligence in Texas is crucial for a successful personal injury claim. For individuals dealing with such complexities, seeking the help of a seasoned car accident lawyer is essential. Your attorney will be able to guide you and fight to ensure you are able to maximize your claim for compensation.
