Fatal Car Accidents in Texas

The sudden and unexpected loss of a loved one can be incredibly difficult to deal with. Unfortunately, more than 4400 people died as a result of vehicle crashes in our states in 2022 alone. Every year, thousands of lives are lost as a result of vehicle collisions that occur on our roadways.

In many cases, fatal accidents are a result of reckless and negligent drivers. We see many of these accidents take place due to drivers who are impaired by alcohol or drugs, speeding, or otherwise negligent. After losing a loved one in a fatal accident, families have the ability to file a claim for wrongful death against the responsible party.

Recovering Damages with a Lawsuit

When pursuing a wrongful death lawsuit following a fatal car crash in Texas, key factors come into play to determine eligibility for damages. Generally speaking, one must establish that another party’s reckless or negligent behavior led directly to the accident and subsequent loss of life. This could include instances where drivers fail to obey traffic laws like speeding or driving under the influence, distracted driving due to mobile phone use while operating vehicles, or any other actionable misconduct on behalf of individuals involved.

Texas law recognizes specific categories of individuals who may be eligible to file such lawsuits as plaintiffs—typically immediate family members, including spouses, children (both biological and adopted), and parents. In some cases where there are no surviving qualifying relatives available within three months after the deceased’s passing date, challenges arise when establishing eligibility regarding distant family members or even financial dependents. It is important to reach out to a car accident lawyer immediately to determine your legal options and get started on protecting your rights.
