Car Accidents in Texas

Every year, preventable motor vehicle accidents continue to be the cause of tens of thousands of collisions across our state. Far too often, car crash victims are forced to go through extensive medical treatment. Many victims have to spend significant time off work to recover. Unfortunately, negligence plays a role in far too many accidents that occur in our state.

We see many people hurt in accidents caused by speeding drivers, drivers who fail to yield, and drivers who run red lights at intersections. After being hurt in a car crash, it is crucial that you are able to take legal action against the responsible party. In order to prevail, you must be able to demonstrate negligence existed at the time of the crash.

How Do I Determine Who Is at Fault for the Car Accident?

If you’ve been injured in a car accident, you have the option to file a personal injury lawsuit. To do this successfully, you need to establish fault, which can be quite challenging. In the context of motor vehicle accidents, this typically involves demonstrating that the defendant had a duty of care towards you and that they breached this duty. This breach might result from actions like excessive speeding, driving under the influence, or other reckless behaviors.

Once you’ve proven a breach, you must also show that this breach directly caused the accident and led to your injuries. While this might sound straightforward, it’s important to be aware that insurance companies often attempt to shift blame onto you for any injuries and damages that occurred. This highlights just how important it is for you to seek legal representation from a dedicated car accident attorney.
