Car Accidents in Texas

Annually, automobile accidents in Texas result in a staggering number of injuries. In fact, it is estimated that one person becomes injured approximately every two minutes in our state. The unfortunate truth is that a significant portion of these accidents are caused by negligent drivers.

When drivers fail to adhere to safe driving practices, they put others at risk of severe harm. Unfortunately, there are numerous incidents where innocent individuals are left with painful physical and emotional injuries as a result of these negligent actions. After being hurt in a motor vehicle accident, you should take legal action right away to ensure your rights and best interests are protected.

Can I Sue if I Share Fault for the Crash?

Yes, you can still file a personal injury lawsuit in Texas if you were partially at fault for the accident. Texas follows the rule of comparative negligence, which allows you to recover damages as long as you were not primarily at fault for the accident. However, the amount of damages you can recover may be reduced in proportion to your fault.

Under Texas law, an injured party’s negligence is considered in relation to the negligence of all parties involved. If you are found to have been partially at fault, your damages will be reduced by the percentage you are at fault. For instance, if you were 20% at fault for the accident, you would be entitled to receive 80% of the total damages awarded by the court. However, if you are more than 50% responsible for the accident, you are unable to receive compensation. This makes it important for you to seek representation from a Texas car accident lawyer right away.
