Fatal Motorcycle Accidents in Texas

In 2022, a total of 562 motorcyclists died as a result of automobile accidents in Texas. Statistics show that approximately 39 percent of total motorcyclists who were killed in these accidents were not wearing helmets.

Unfortunately, even wearing a helmet cannot prevent a person from suffering severe and fatal injuries all of the time. There are many instances where victims lose their lives as a result of fatal accidents caused by negligence. It is crucial that families are aware of the legal options that they have during these difficult times.

Pursuing a Wrongful Death Case

According to the Texas Wrongful Death Act, only the deceased person’s spouse, children, or parents have the legal standing to initiate a wrongful death claim. However, if they fail to do so within three months following the person’s passing, the estate of the deceased individual can pursue a claim on their behalf.

In addition, the legal representative, heirs, or the estate of the deceased has the right file a survival lawsuit against the responsible party for causing the decedent’s death. These heirs can include individuals designated to inherit under the decedent’s will, or if there is no will, those specified by Texas laws governing intestate succession.

A wrongful death claim provides entitled parties with the ability to request compensation for some of the damages and losses that they face. This can include recovering compensation for medical costs, funeral costs, and more. Seeking help from a Corpus Christi wrongful death lawyer can help to ensure that your family has the best chance of getting justice.
