Proving Negligence After a Fatal Crash

After experiencing the loss of a loved one, you have the ability to file a wrongful death claim. You must be able to demonstrate that the elements of negligence were present at the time of the crash. This includes showing:

  • Duty of Care: This pertains to the obligation of a party to exercise a reasonable level of caution and care. For instance, in the context of road safety, motorists are responsible for adhering to traffic laws, and demonstrating their duty of care to others on the road.
  • Breach of Duty of Care: This signifies the failure of a party to meet their duty of care, constituting the negligence aspect of the case. In a fatal pedestrian collision, a breach of duty of care could involve actions such as speeding, driving under the influence, or reckless driving that results in an accident.
  • Causation: In a wrongful death claim, the plaintiff must establish a direct link between the negligent act (the breach of duty of care) and the fatal injuries.
  • Damages: This includes the losses suffered by you due to the death, including both economic and non-economic impacts of the wrongful death.

To provide yourself with the best chance of getting justice, it is important to seek legal representation from a dedicated pedestrian accident lawyer right away.
