Car Accidents in Texas
Motor vehicle accidents are a daily occurrence in Texas. Statistics on 2022 show that there was not one day that went by where someone was not killed in an automobile accident. Unfortunately, hundreds of people are injured as a result of collisions in our state every day as well. The overwhelming consequences that motor vehicle accidents bring can be quite challenging to deal with. Quite often, victims and their families struggle to move forward.
If you’ve been hurt in a car accident, a personal injury case can provide you with financial relief to cover some of the losses and damages that you face. It is important to understand what is required of you when it comes to filing a personal injury action.
Filing a Successful Lawsuit
After a crash, you have the ability to file a personal injury claim. In order to file a legal claim with success, you must be able to demonstrate that the elements of negligence existed. This involves showing:
- The duty of care existed at the time of the crash.
- The person you named as the defendant breached the duty.
- The breach of the duty was the proximate cause of the crash.
- The crash caused by the breach resulted in your damages.
In addition, you must file your personal injury action within the statute of limitations. In general, this is two years from the date of the accident. There are a few exceptions to this time. For this reason, it is vital that you seek representation from a Texas car accident lawyer right away.
